These Terms of Service ("Terms") govern your access to and use of the Project 94 Hockey API and related website (the "Service"), operated by Accelerated AI and Data Solutions, LLC ("Company," "we," "us," or "our"), doing business as Project 94 Hockey. By creating an account, subscribing, or using the Service, you agree to these Terms.

1. The Service

The Service provides subscription-based API access to proprietary hockey statistics, model outputs, and related data for personal and commercial analysis, application development, research, and publishing derived insights. Features, fields, rate limits, and quotas may change as we improve the Service.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and API keys, for all activity under your account, and for notifying us promptly at [email protected] of any unauthorized use.

3. Subscriptions, billing, and taxes

Paid access requires an active subscription. Prices are shown at checkout and may change for new subscriptions or renewals after notice. Subscriptions auto-renew at the then-current rate until you cancel through the Stripe billing portal. You authorize us and our payment processor (Stripe) to charge your payment method on each renewal.

All subscription fees are non-refundable. If you cancel through the Stripe billing portal, your subscription is set to end at the close of your current billing period and API access continues until then; no partial refunds are provided for unused time. Deleting your account from the dashboard ends access immediately and cancels any active Stripe subscription. Applicable sales tax, VAT, or similar taxes are calculated at checkout based on your billing address and our tax registration obligations.

4. API data license

Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Query the API and use responses in your own applications, dashboards, research, and analysis;
• Display derived insights (charts, rankings, commentary, aggregated statistics) in your products or publications, provided you do not misrepresent the data as official NHL or league data.

You may not, without our prior written permission:

• Resell, sublicense, or provide third-party access to the API or raw API responses;
• Redistribute, publish, or make available bulk or systematic copies of raw API payloads (e.g., re-hosting datasets, data feeds, or scrapes of the API);
• Remove proprietary notices or use the Service to build a competing data product.

Your license to make new API queries ends when your paid access ends. If you cancel through the billing portal, that is typically the close of your current billing period. You may retain derived insights already produced, but you must cease new API queries when access ends and delete stored raw API responses unless we agree otherwise in writing.

5. Acceptable use and rate limits

You will not abuse, overload, scrape beyond documented limits, circumvent authentication, share API keys, probe for vulnerabilities, or use the Service unlawfully. We enforce rate limits and daily quotas; exceeding them may result in throttling or suspension. We may update limits to protect Service stability.

6. Third-party rights and NHL disclaimer

The Service is not affiliated with, endorsed by, or sponsored by the National Hockey League ("NHL"), NHL teams, or any other league or team. NHL and team names are used for identification only. You are responsible for your own compliance with third-party terms, trademarks, and platform rules when displaying hockey-related content.

7. Availability

We provide the Service on a best-effort basis. Standard plans do not include a guaranteed uptime SLA, service credits, or maintenance windows notice unless we agree in a separate written agreement.

8. Disclaimers

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DATA MAY CONTAIN ERRORS, OMISSIONS, OR DELAYS AND MAY CHANGE WITHOUT NOTICE. DO NOT RELY ON THE SERVICE FOR BETTING, WAGERING, OR SAFETY-CRITICAL DECISIONS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Suspension and termination

We may suspend or terminate access for violation of these Terms, non-payment, abuse, or legal requirement. You may delete your account at any time from the dashboard; deletion removes your login, API keys, and local subscription records from our product database and ends API access immediately. Sections that by nature should survive (license restrictions, disclaimers, liability limits, governing law) survive termination.

11. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance. If you do not agree, cancel your subscription and stop using the Service.

12. Governing law and contact

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Exclusive venue for disputes is in state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.

Accelerated AI and Data Solutions, LLC ("Company," "we," "us," or "our"), operator of the Project 94 Hockey API (the "Service"), respects your privacy. This Privacy Policy explains what we collect, how we use it, and your choices.

1. Information we collect

• Account data: email address, password hash, session token version, and account creation/update timestamps.
• Billing data: Stripe customer ID, subscription status, plan, price, billing interval, renewal/cancellation dates, and related subscription fields stored in our product database. Payment card numbers are processed and stored by Stripe; we do not store full card numbers.
• API keys: a hash of each key (not the full secret), an optional display suffix, optional key name, creation time, and last-used timestamp/path.
• API usage: daily aggregated counts per account, API key (or bearer session), HTTP method, endpoint path, status code, error counts, and latency totals for quota enforcement and operations. We do not store the body of API requests or responses.
• Product events: coarse event names (for example sign-up, login, checkout started, subscription changes, API key created, account deleted) with optional related identifiers and JSON properties.
• Website analytics: we use Cloudflare Web Analytics, a privacy-first, cookieless measurement tool, to understand aggregate site traffic (such as page loads, referring sites, general location, and device type). It does not set cookies, does not use client-side state to track you across sites, and does not build advertising profiles. We do not receive information that identifies you personally through this analytics.
• Support and communications: information you include when you email [email protected].
• Technical logs: our application logs request method, path, status code, latency, and authenticated user/API-key identifiers where available. Client IP addresses may be used for rate limiting and may appear in hosting or error-monitoring logs; we do not store full IP addresses in our product database.

2. How we use information

We use personal data to provide and operate the Service, authenticate users, process subscriptions, send transactional emails (e.g., password reset), enforce rate limits, prevent abuse, respond to support requests, improve reliability, and comply with law.

3. Legal bases (EEA/UK)

Where GDPR or UK GDPR applies, we process data based on: (a) contract performance (providing the Service you subscribed to); (b) legitimate interests (security, abuse prevention, product improvement); and (c) legal obligations (tax and accounting records).

4. Service providers

We use service providers who process data on our behalf when you use the Service:

• Stripe — payment processing, subscription billing, invoices, and tax calculation
• Postmark or an SMTP email provider — password-reset and other transactional email (whichever is configured for the deployment)
• DigitalOcean — application hosting and managed PostgreSQL databases in production
• Sentry — error monitoring, only when SENTRY_DSN is configured for the deployment
• Cloudflare — privacy-first, cookieless website analytics (aggregate traffic measurement) when enabled for the deployment

These providers process data under their own terms and privacy policies. We do not sell your personal information.

5. Retention

While your account is active, we retain the data described above in our product database for as long as needed to operate the Service. We do not currently apply automatic deletion schedules to API usage aggregates or product events during an active account.

When you delete your account from the dashboard, we delete your user profile, API keys, password-reset tokens, and subscription records from our product database, remove daily API usage rows tied to your account, and cancel any active Stripe subscription. Product event records may be retained without your user identifier. Stripe may retain payment, customer, and invoice records under its own retention policies and legal requirements.

Application, hosting, and error-monitoring logs may retain technical metadata (such as request paths or error details) for a limited period according to those systems' settings. We may also retain information where required for tax, accounting, fraud prevention, security, or legal compliance.

6. Security

We use industry-standard measures including hashed passwords, hashed API keys, TLS in transit, and access controls. No method of transmission or storage is 100% secure.

7. Your rights

Depending on your location, you may have rights to access, correct, delete, or receive a copy of your personal information, or to object to or restrict certain processing. You can delete your account from the dashboard. For other requests, email [email protected]. U.S. residents in certain states have additional rights described in Section 11.

8. Cookies and tracking

Our web app stores your access token in sessionStorage to keep you logged in during the browser session; this is cleared when you log out or close the tab/session according to your browser behavior. We do not use third-party advertising cookies or cross-site behavioral tracking on the site.

For aggregate traffic measurement we use Cloudflare Web Analytics, which is cookieless and does not store or share personally identifying information. Because it does not use cookies or similar tracking technologies that require consent, no cookie-consent banner is required. If error monitoring (Sentry) is enabled for a deployment, it may collect technical diagnostic data about application errors, which can include request metadata. If we later add analytics or advertising technologies that require consent, we will update this policy and provide the appropriate controls.

9. International transfers

We operate from the United States. If you access the Service from outside the U.S., your information may be processed in the U.S. and other countries where our providers operate, which may have different data protection laws.

10. Children's privacy

The Service is not directed to children under 18. We do not knowingly collect personal information from children. Contact us if you believe a child has provided us data.

11. U.S. state privacy rights

If you are a resident of California, Virginia, Texas, Colorado, Connecticut, or another U.S. state with a comprehensive consumer privacy law, you may have the following rights, subject to applicable exceptions:

• Know and access — what personal information we collect, how we use it, and the categories of recipients (see Sections 1–4).
• Delete — personal information we hold about you, using the dashboard account-deletion flow or by emailing us.
• Correct — inaccurate personal information (for example, your account email).
• Portability — a copy of personal information you provided, in a portable format, upon a verified request.
• Opt out — of the sale of personal information and, where applicable, certain targeted advertising or profiling. We do not sell personal information and do not use it for cross-context behavioral advertising.

How to submit a request. Email [email protected] with the subject line "Privacy request" and tell us which right you are exercising. We may verify your identity using your account email or other reasonable confirmation. You may designate an authorized agent to submit a request on your behalf; we may require written proof of authorization and direct verification from you.

Appeals (Virginia and other applicable states). If we deny your request, you may reply to our response to appeal. We will explain our decision in writing within the time required by applicable law.

Non-discrimination. We will not deny service, charge different prices, or provide a different level of service solely because you exercised a privacy right, except as permitted by law.

Cookies and tracking. We use essential browser storage to keep you logged in (see Section 8). We do not use third-party advertising cookies today. If we add advertising or analytics that require opt-out under state law, we will update this policy and provide a clear opt-out mechanism.

Do Not Track. We do not currently respond to "Do Not Track" browser signals because there is no uniform industry standard.

Retention. See Section 5 for how long we keep personal information.

12. Changes and contact

We may update this Privacy Policy. Material changes will be posted here with an updated date.
